Brand is an identifier for a Product or Service.
Brands distinguish the product or services of one business/person from another.
Customers use the Brand identity to distinguish the products that they want and the ones they don’t. Branding is an age-old concept and is been practiced for hundreds of years.
When brands turn famous, they also become valuable.
The valuation of the brands is directly proportional to the goodwill that it has in its customers minds.
It is also a reality that the Brands are often abused.
As soon as the brands become famous, we realize that there are counterfeits and lookalikes that deceive even the most experienced customers and often these counterfeits and lookalikes are poor performance products, that dent in to the goodwill generated by the original brands and the owning businesses.
When the brands become valuable, they also require some sort of Legal Protection. This legal protection allows them to regulate the asset aspect of the Brands in the same manner as that of fixed assets like apartments and other immovable properties.
Thus, the registration of brands as Trademarks allows the Brand Owners to stop other traders from unlawful use of the mark of the registered owner and to obtain relief in respect of the trademark by way of filing a suit for infringement of his right and obtain:
(1) Injunction,
(2) Damages and
(3) Account of profits derived from the unauthorized use of the Trademark.
If you are an entrepreneur, you would have certainly experienced the trouble of coming up with a brand name that is unique, non overlapping, has a domain name available and is registrable
under the Trademarks Act. It is not easy to come up with such names. In 2021 alone, around 17 million Trademarks are filed worldwide that includes almost half million Trademarks filed in India and about one million Trademarks are filed in China. These numbers depict the high demand for Branding goods and services. What is fuelling up this demand? Several factors indeed
(1) Consumer behaviour: Consumers are no longer just buying from the physical stores, they are buying from e-commerce marketplaces, digital stores and even social media handles.
Consumers need more choices with brands, they share and read experiences of other consumers with goods and services of a particular brand. This leads to more sellers, floating more brands on the internet and diversity in the choice of brands.
(2) Seller Behaviour: Due to lower threshold of investment in fixed assets like factories, warehouses and physical stores, there are more sellers than ever in this world. Not only there are more people selling goods and services, each seller is also selling more products across more categories of goods and controlling several SKUs (Stock Keeping unit). It is not surprising to see the same seller offering goods that are generally associated with different trade channels and are purchased by different classes of customers.
(3) Drop Shipping: With evolution of ecommerce, a new category of sellers has emerged known as drop shippers.
These sellers accept the customer orders without keeping the stocks in hand. They indeed place order on the manufacturer or stockists to fulfil the orders they received. This whole process of supply chain management also involves affixing the brand of the drop shipper (on product or packaging) before despatch.
All e-commerce companies have Intellectual Property policies and framework to report Brand Abuse and procedures for taking down fake product listings. E commerce portals like Amazon encourage sellers to build and protect the brands within their ecosystem. This not only provides a peace of mind to the sellers but also develops the trust factor with buyers. How do they do it? The first step is to allow sellers to demonstrate that they are the bonafide owners of a Brand by asking them to upload their Trademark/Patent/Design Registration certificates. This triggers a verification code that is sent out to the email address mentioned in the official website of the Trademark/IP registry. Once the code is verified with Amazon Brand Registry, the seller (now recognized now as the “True Brand Owner”) gets tools and privileges like exclusive access to push ads, report IP violation and own a brand store. With no registered Trademark or Intellectual Property, it is impossible for a seller to report brand abuse to ecommerce companies.
